Kent County Levy Court Administration consists of the County Administrator's Office, Economic Development Office, Information Technology Office, Personnel Office, and Facilities Managment Division. These offices support the seven elected Levy Court Commissioners as well as other County departments and elected County offices by administering all County functions relating to employees and infrastructure.

The Administration is headed by the County Administrator who is the chief appointed officer of the County. His duties include advising Levy Court Commissioners on issues affecting Kent County and managing the day to day operations of county government. The County Administrator supervises all appointed department managers, provides direct oversight for the Information Technology, Economic Development, and Personnel offices, and coordinates the activities of all departments on behalf of Levy Court.

The Department of Administration provides for the security and general maintenance of all County buildings.

How to Request Kent County Government Records

The Freedom of Information Act (FOIA), is a law that gives a person the right to access information from governmental agencies. FOIA provides that any person has the right to obtain access to federal agency records, except for those which are protected from public disclosure by one of nine exemptions or by one of three special law enforcement record exclusions.

To request a FOIA from Kent County Levy Court, complete the Request for Public Records form provided on our website and either mail it to: Kent County Levy Court, 555 Bay Road, Dover, Delaware 19901 or fax it to 302-736-2279. Additionally, FOIA request can be emailed to: admin@kentcountyde.gov.

Clerk of Peace Office (Marriages & Civil Unions)

The Clerk of the Peace witnesses County documents; attends all formal Levy Court Meetings; records all acts as custodian for the Minutes of the Levy Court Meetings; advertises and posts County ordinances; countersigns warrants drawn on County funds. Issues marriage licenses; and performs marriage ceremonies.

Applying for a Marriage License 

Both parties must appear together Monday through Friday, between the hours of 8:00 a.m. to 4:15 p.m.

A translator is required if one of the parties does not speak English.  The translator must have proper identification and must be at least 18 years of age.

Residency/Waiting - Residents and non-residents must apply for a license 24 hours prior to the time of the ceremony.

• Validity - The Delaware license is only valid for 30 days from date of issue.  The ceremony must be in the State of Delaware.

A valid DMV issued ID/Driver’s license, Passport, Military ID (Active Military Duty) is required.  ID must include date of birth.  Proof of address is required.  To verify the authenticity of an applicant’s identification, the office of the Clerk of the Peace may also require additional documentation such as a birth certificate or social security card.

The current name on your valid identification will be the name used for your marriage license. You will be asked to provide your parent’s birth names, place of residency and birth so please have this information prior to applying.

• Divorced/Annulled/Widowed - All parties must produce an original or certified final decree of divorce/annulment or a certified death certificate. These will be returned at application.  A certified translation must be presented with original or certified documents that are not in English.  You will need to know the dates of your previous marriage and where it took place.  If an applicant has been divorced or dissolved a legal partnership and taken back their former name, they must bring the original or certified copy of the name change court documents. No photocopies accepted.

• On Probation or Parole? An original letter of permission from the Probation Officer is required before a license will be issued.

• Minors - All applicants must be 18 years of age. Minors must petition Family Court for authorization to marry.

• License Fee - The cost of a Delaware Marriage License is $70 for residents/$120 non-residents (Cash Only). Additional fee for ceremonies performed by the Clerk of the Peace office is $50 for residents/$100 non-residents (Cash Only).

*Couples getting married in Kent County are encouraged to make certain that the person performing their wedding ceremony is authorized to do so.

The office issues mobile home certification letters, administers the senior tax credit program for the State, and provides assistance to the community's legal representatives and title searchers.

How to use the Kent County Recreation Center

DROP-IN PROGRAMS

A valid "Drop-In Punch Card" is required to participate in any Drop-In program at the Kent County Recreation Center. Punch Cards can be purchased at the Rec Center office Monday-Friday, 8 AM to 5 PM using CASH, or CREDIT CARD. Cards may also be purchased after 5 PM weekdays, and on weekends, with the following restrictions: Limit of 2 per purchasers, CASH ONLY transaction (no bills greater than $20 will be accepted). Cards are $20 each and are good for 10 individual sessions of any drop-in program. A registration form must be filled out with EACH purchase.

PRE-REGISTERED PROGRAMS

Community recreation programming is available for pre-registration on a daily basis. These programs are advertised in the quarterly brochure sent out by Kent County Levy Court. Pre-registration can be made in the office Monday-Friday 8 AM to 5 PM using cash, check, or credit card. Please register online through CivicRec.

The Kent County Division of Libraries operates the only mobile library in Kent County. In addition to books and audio/visual material, you can also pick-up items placed on hold, return library materials, sign up for programs, get a library cards, use a public access laptop, enjoy limited printing services, and or take advantage of our free public wi-fi hotspot.

The Registrar of Wills Office records wills after death and other documents pertaining to estate matters in Kent County, Delaware. The Office is responsible for overseeing the appointments of personal representatives and for administering estate proceedings. This office is also held accountable for making sure that the estate is in compliance with the Delaware law and Kent County policies. All estate matters are maintained as permanent records.

The function of the Sheriff's Office is to service the Citizens of Kent County by performing many functions for the State of Delaware Courts (Superior Court, Court of Common Pleas, U.S. District Court and the Court of Chancery). The Sheriff's Office serves legal notices to include (subpoenas, levies, summons, etc.) Additionally, the Sheriff's Office auctions real estate in accordance with the Delaware Code.
